In October 2018, Canada became the second country in the world to legalize marijuana for recreational use. But the issue of recreational drug use is not new - substance use, including marijuana, has been a challenge for employers for generations. While many trucking companies, for example, have been addressing potential drug use via US Department of Transportation testing protocols for cross-border work, these requirements will not translate effectively to Canadian workplaces.

This seminar will provide a brief history of substance use in Canada, review current case law and substance-testing technology and examine the difference between determining impairment and prohibition testing.

Participants will receive tools, templates and practical strategies to address impairment in the workplace.

The seminar will also address when employers must accommodate disability and medical use (and when they don’t need to), as well as when and how to discipline an employee who uses substances. 

Participants will leave with an understanding of what the legalization of recreational cannabis means for their operations and practical tools to address impairment in their workplaces. Ample time for Q&A will be available following the presentation.

Of interest to previous attendees, or those considering sending additional staff to the session, court decisions are beginning to establish precedents for companies dealing with employees affected by the use of substances, including medical marijuana.  The case law review will include examples.


Presenter:  Dave Earle, President and CEO, BC Trucking Association

The BC Trucking Association is a member-based, province-wide, non-partisan, non-profit motor carrier association representing the road transportation industry in British Columbia. 

Among Dave’s board and committee experience, he is a past president of the Employers’ Forum and the current Employer Caucus Chair for WorkSafeBC’s Policy and Practice Consultation Committee.

As the previous employer co-chair of the Program Administration Committee for the BC Construction Industry Substance Abuse, Testing and Treatment Program, and previous co-chair of the Board of Trustees for the Construction Industry Rehabilitation Program, Dave is an expert on the topic of substance use, testing and treatment in an employment setting.
